Cobalt Boats files patent-infringement lawsuit against Sea Ray

January 29th, 2015

Cobalt Boats LLC is suing Sea Ray Boats, saying the company has infringed on Cobalt’s patent for a submersible swim step.

The complaint filed in U.S. District Court for the Eastern District of Virginia said Sea Ray’s “reckless” infringement of the patent has caused Cobalt Boats to lose sales.

Daniel Kubera, a spokesman for Sea Ray’s parent company, Brunswick Corp., told Trade Only Today it is company policy not to comment on pending litigation.

The complaint said Sea Ray’s manufacture, use, and sale of boats having a submersible swim step infringes on Cobalt’s U.S. Patent No. 8,375,880, which was issued in 2013.

“As a result of Sea Ray’s willful infringement of the ‘880’ patent, Cobalt has lost sales to Sea Ray and has been and continues to be damaged by Sea Ray’s infringing conduct,” said the complaint, which Trade Only Today obtained.

Attorneys representing Cobalt asked in court documents that a jury determine “adequate” compensation for Sea Ray’s infringement, as well as coverage of attorneys’ fees, costs and expenses connected with the lawsuit. Cobalt is also seeking a permanent injunction to prohibit future sales of boats with the swim step feature.

“We are very proud of our innovative products and intend to protect our patent rights,” Cobalt Boats CEO Paxson St. Clair said in a statement.

The swim step feature has been “a huge success for Cobalt” since it was introduced to the marketplace, the complaint said. Beginning last year, Sea Ray — “a direct competitor of Cobalt” — began promoting and selling boats with a swim step that “appears to copy Cobalt’s” and infringes on Cobalt’s patent, the complaint said.

The swim step is offered on 220, 240, 270 and 290 Sea Ray Sundecks, according to the complaint.

Sea Ray set to resume production at Florida facility

January 30th, 2015

Brunswick Corp. is increasing capacity to meet demand for its Sea Ray L-Class yachts by reinstating operations at the Sykes Creek plant in Merritt Island, Fla. Operations there were suspended last March.

“We’re sold out, as we keep saying, in certain of these new products, the larger products … for about a year,” Brunswick CEO Dustan E. McCoy told investors and analysts during a conference call to discuss earnings on Thursday.

Reinstating operations at the plant will allow the builder to increase output of L-Class yachts, as well as remove inefficiencies and costs that are being incurred through the “enormous demand,” McCoy said.

“We’re also doing this … in all of our other businesses,” McCoy said. “We opened a significant capacity expansion at Boston Whaler. We need to do that for both big product but also for demand for existing product.

“It’s true in all our businesses, including Mercury and our aluminum-boat businesses,” he added. “So what we’re doing is, as we’re working hard to meet demand, we are going through inefficiencies and having additional cost as we expand capacity, bring new product in line and open new plants.”

The company had said upon suspending operations at the plant that their ability to produce could meet demand for more than twice 2.5 the 2012 yacht market.

“Throughput is generally on our expectations,” McCoy said. “Cost is a fair bit above our expectations. And I think what we didn’t take into account well enough … was the model mix that we began to put through that facility and the complexity that it brought. And as a result, we have a real need for Sykes Creek. And I think if we’re also honest with ourselves, we didn’t quite anticipate the demand being at the level it is. So it’s a great problem to have, but it’s something we’ve got to deal with here in the first half.”

Even after bringing the new facility online, the backlog on the L65 is expected to last until 2016. “We’d like to reduce the backlog,” McCoy said.

He said the company will be announcing further investments and potential acquisitions it will make in 2016 at its investors meeting later this year, but added that “we think growth opportunities exist around engines and P&A.”

Azimut Yachts sales see increase at MarineMax

February 2nd, 2015

Azimut Yachts is capitalizing on a Sea Ray backlog in MarineMax stores.

Although buyers of the two brands often are different customers, MarineMax CEO Bill McGill told analysts and investors during a conference call Thursday that some customers are swayed by the fact that the Sea Ray inventory isn’t there.

“The smaller products are doing well and we do not have a new 50 from Sea Ray, as an example,” McGill said. “It will be coming, but in the 40-foot and 50-foot range, we are still struggling with some of the older product. And Azimut is a great opportunity, understanding that in some cases they are different buyers, but in some cases, when someone wants a new 50 and we don’t have it with Sea Ray, they will buy the Azimut.”

However, McGill said the demand for the new Sea Rays is very strong and that he does not think the company will permanently lose market share.

“When we call out the larger Azimut, Hatteras and Ocean Alexanders” as selling well, “those really don’t compete with what Sea Ray is bringing into the marketplace, but we are talking 70 feet and above,” McGill said. “And so our specific comments would not impact or correlate with the strength or the cadence of product coming out of Sea Ray from the 65s or the 59s.

“We certainly see very strong interest in customers for those models. And once the models are fully integrated and out in the field, we think Sea Ray is going to have dramatic share growth with really any of the new models we’re bringing out,” McGill said. “That’s what the story has been so far. So we think whatever share they’ve lost, they’ll gain that share back.”

Same-store sales rose 45 percent during the company’s fiscal first quarter, which ended Dec. 31, and unit growth was near 25 percent for boat sales, CFO Michael McLamb said. But those numbers are driven by “a handful” of new sales.

“It doesn’t take too many $5 million or $6 million yachts to add a fair amount of revenue in a small quarter like the December quarter,” McLamb said. “January is going to be a good month, but I have to repeat that January is a small month in the quarter. So I think the key point is, if you look at January and February and combine them, March is as big as the two of those combined. And so, our cautionary language — well, certainly trends right now are encouraging.”

McLamb cautioned that weather is a huge factor at this time of the year.

“We are encouraged by what we are seeing at the boat shows … but you know we are also very cautious,” McLamb said. “You know, as an example, Boston got hammered — you all missed it, everybody missed it in New York with the blizzard, but you know a few events like that can have a dramatic impact on the March quarter, as we’ve seen in the last couple of years. So, we just … need to get through the March quarter and in the June quarter we’ll know a lot better.”

Stora affärer på G..

Italian yard has deal to acquire Bertram Yachts

February 5th, 2015

The parent company of the Baglietto shipyard said it has signed a letter of intent to buy Bertram Yachts from the Ferretti Group.

Several Italian publications are reporting that the Gavio Group, which took over Baglietto in 2012, expects the transaction to close by March 31 and that it is conditioned on due diligence. Baglietto is located in La Spezia, Italy, and Bertram is based in Florida.

“I am very pleased with this transaction,” Argofin and Baglietto president Beniamino Gavio said in a statement, according to the La Spezia Citadel.

“Bertram is, for sure, the brand most akin to Baglietto, as they share many similarities: a family history made by legendary yachts; records broken and competitions won; a logo that, for both brands, are symbols of freedom and strength (the eagle and the seagull); and a very strong national identity that goes hand in hand with far-reaching international recognizability.”

The Gavio Group entered the boatbuilding industry after buying Cantieri Cerri in 2011, according to the Medi Telegraph.

By including Bertram in its portfolio of brands, the group will further extend the range of boats it produces. It will also create a “hub” in the yacht segment, capable of creating strong synergies by sharing resources, optimizing costs, integrating sales networks and further promoting its chances to successfully operate in the fast-growing U.S. market, the publication said.

Bertram was established in 1960 by Richard Bertram to build the iconic 31 Moppie.

The Ferretti Group acquired Fort Lauderdale-based Allied Richard Bertram Marine Group in September 2008.

In the summer of 2013, Ferretti Group America president and CEO James Henderson discussed with Trade Only what he called a “fairly significant reorganization.”

“We have brought on board Robert Ullberg, who is one of the best-known sportfish designers in the American industry,” Henderson said at the time. “We’ve relocated the factory from Miami to Cape Canaveral, Fla., and we’ve hired a brand-new team. We brought some of our existing employees to Cape Canaveral, but we also brought a lot of new people on board.”

Henderson played a key role in restructuring Bertram, developing a new operating plan, repositioning the brand, recruiting a new team and relocating the manufacturing operations.

Asked during the interview whether the group was equally focused on Ferretti, Riva, Pershing and Bertram in North America, Henderson replied:

“I would put Bertram to one side a little bit because it’s a brand we’ve only really started to refocus on in the last couple of years. The main focus for us in the Americas is Ferretti, Custom Line, Pershing and also Riva. Bertram, as well. But in terms of our sales performance and success, Ferretti and Custom Line because Ferretti is a flybridge motoryacht that goes from 50 to 96 feet, and we have an incredible range.”

The new Scarab 255 is the largest jetboat on the market at 25 feet -- a full 4 more feet of fun than current Scarab models. Fast, fierce, and functional, this lady belongs on the water with you.

35-40.000€ innan skatt.
